Welcome to Homde. The terms “we,” “us,” and “our” refer to Homde Inc (“Homde”). Homde operates this website and makes available related information, content, features, and tools to provide visitors with product information and links to third-party retail websites (collectively, the “Services”). The Services are hosted using Shopify technology.

Homde does not accept or process orders, payments, returns, or exchanges through this website. When you select a product link or purchase button, you will be directed to Amazon or another third-party website. Any purchase is completed on that third-party website and is governed by the terms and policies displayed there. The seller of record is the seller identified on the applicable Amazon product, checkout, or order-confirmation page and may be Homde, a Homde affiliate, or an independent third party.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

SECTION 2 – PRODUCT INFORMATION

We make reasonable efforts to present product information accurately and to keep images, specifications, dimensions, features, descriptions, prices, promotions, availability, and other product-related content current. Nevertheless, information on the Services may be delayed, incomplete, inaccurate, or out of date. Product information, availability, prices, seller identity, shipping terms, taxes, discounts, promotions, and other transaction details may change on Amazon or another third-party website before corresponding information on the Services is updated.

Before making a purchase, you must review and rely on the information displayed on the applicable Amazon product page, checkout page, and order confirmation. If information on the Services differs from information displayed on Amazon in connection with your transaction, the information displayed on Amazon at the time of the transaction controls. The Services provide product information and links only. You cannot place an order with Homde through this website, and clicking a purchase button does not create an order, reserve inventory, fix a price, or form a sales contract through the Services.

When you follow a link to Amazon or another third-party website, any order you submit is made directly on that third-party website. Your purchase contract is with the seller of record identified on the applicable product, checkout, or order-confirmation page, which may be Homde, a Homde affiliate, or an independent third party. Your order is subject to that seller’s terms and to the marketplace’s applicable conditions of use, sale, payment, cancellation, return, refund, warranty, dispute-resolution, and other policies.

Amazon or the seller of record, as applicable, determines whether to accept, reject, modify, or cancel an order and is responsible for issuing the applicable order confirmation. Homde’s website cannot access, change, cancel, or guarantee an order placed on Amazon unless a separate Amazon communication expressly identifies Homde as the responsible seller and provides a method for doing so.

You are responsible for reviewing your order and the identity and terms of the seller before submitting it. Questions or claims concerning an Amazon order should be directed through Amazon’s customer-service or order-support channels or to the seller identified in the order details. If Homde is identified as the seller of record, any seller obligations will be governed by the terms and policies applicable to that Amazon transaction.

You represent and warrant that any purchase you make is lawful and complies with the applicable marketplace and seller terms, including any restrictions relating to resale, export, sanctions, or destination.

SECTION 4 – PRICES, PROMOTIONS, AND PAYMENT

The final price and terms applicable to a purchase are those shown on the applicable Amazon product and checkout pages when you submit the order, together with the order confirmation. Unless the relevant Amazon page expressly states otherwise, displayed product prices may exclude taxes, shipping, handling, customs duties, import charges, or other fees. Prices and promotions may vary by seller, product variation, customer, location, time, currency, platform, or channel.

Payments are submitted to and processed by Amazon or its designated payment service provider, not through the Services. Homde does not collect or store payment-card information through this website for Amazon purchases. You are responsible for providing accurate payment, billing, shipping, and account information to Amazon and for complying with Amazon’s payment terms. Payment disputes, unauthorized charges, and billing questions must be handled under the policies and procedures applicable to the Amazon transaction.

SECTION 5 – SHIPPING, DELIVERY, RETURNS, AND WARRANTIES

Homde’s website does not arrange fulfillment, shipment, delivery, cancellation, return, exchange, or refund for purchases completed on Amazon. These matters are governed by the policies displayed on Amazon and the terms of the seller of record. Delivery dates are estimates unless expressly guaranteed by the responsible marketplace, carrier, or seller.

To the fullest extent permitted by law, Homde is not responsible in its capacity as operator of the Services for inventory shortages, fulfillment errors, shipment loss or damage, carrier or customs delays, failed delivery, or the acts or omissions of Amazon, a seller, a carrier, or another third party. If Homde is separately identified as the seller of record for a particular Amazon order, any obligations Homde has in that capacity remain subject to the applicable Amazon transaction terms, express product warranty, and non-waivable law.

Requests concerning delivery, cancellation, returns, exchanges, refunds, or product warranties should be submitted through Amazon’s customer-service or order-support process or to the seller of record shown in your order details.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including all trademarks, brands, text, displays, images, graphics, product content, reviews, video, audio, and the design, selection, and arrangement thereof, are owned by Homde, its affiliates, or its licensors and are protected by U.S. and foreign intellectual-property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent, except for temporary browser caching and other uses necessarily incidental to ordinary lawful browsing.

Unauthorized use of the Services may violate intellectual-property and other laws. All rights not expressly granted are reserved.

Homde’s names, logos, product and service names, designs, and slogans are trademarks of Homde or its affiliates or licensors and may not be used without prior written permission. Shopify’s and Amazon’s names, logos, product and service names, designs, and slogans are trademarks of their respective owners. All other names, logos, product and service names, designs, and slogans appearing on the Services belong to their respective owners. No appearance of a third-party mark implies sponsorship, endorsement, or affiliation except as expressly stated.

SECTION 7 – OPTIONAL TOOLS

The Services may provide access to tools or functionality offered by third parties that we do not monitor, control, or operate.

You acknowledge and agree that access to such tools is provided “as is” and “as available,” without warranties, representations, or conditions of any kind and without endorsement. To the fullest extent permitted by law, we have no liability arising from or relating to your use of optional third-party tools.

Your use of an optional tool is at your own risk and discretion. You should review and approve the terms and privacy practices under which the relevant third-party provider offers the tool.

To the fullest extent permitted by law, Homde is not liable in its capacity as operator of the Services for any harm, loss, claim, or damage related to your access to a third-party website or your purchase, possession, use, return, or disposal of any third-party product, service, resource, or content. You should carefully review the third party’s terms, policies, product information, and seller details before engaging in a transaction. Complaints, claims, concerns, or questions about a third-party transaction should be directed to Amazon or the seller of record, as applicable.

Links are provided for convenience and product discovery and do not, by themselves, constitute an endorsement or warranty of any marketplace, seller, product, service, or content.

SECTION 9 – RELATIONSHIP WITH SHOPIFY AND AMAZON

The Services use Shopify technology for website hosting and related functionality. Shopify is not responsible for the product information we publish, the outbound links we provide, or any transaction you complete on Amazon or another third-party website. By using the Services, you acknowledge that Shopify is not a party to any such third-party transaction and, to the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from those transactions or your use of the Services.

Amazon is an independent third-party marketplace and is not owned, operated, or controlled by Homde. Except to the extent expressly disclosed, no agency, partnership, joint venture, employment, franchise, or endorsement relationship is created between Homde and Amazon by the Services or by any link. Amazon does not control these Terms or the content of the Services.

Any Amazon transaction is subject to Amazon’s applicable terms and policies and to the terms of the seller of record. Amazon and the seller independently determine the information and terms shown on Amazon, including current price, availability, fulfillment, payment, delivery, taxes, returns, and refunds.

SECTION 10 – PRIVACY POLICY

Personal information we collect through the Services is subject to our Privacy Policy. Certain information may also be processed by Shopify under Shopify’s privacy terms, available at Shopify Privacy Policy.

Because the Services are hosted using Shopify technology, Shopify may collect and process information about your access to and use of the Services to host, secure, maintain, and improve relevant functionality. Information submitted through the Services may be transmitted to Shopify and other service providers, including providers located outside your state, province, or country. Please review our Privacy Policy for details about how we and our service providers collect, use, disclose, retain, and protect personal information and about any privacy rights available to you.

When you follow a link to Amazon or another third-party website, that third party separately collects and processes information under its own privacy notice. Information you submit on Amazon, including account, payment, billing, and shipping information, is not submitted to Homde through the Services, although Homde may receive limited order or customer information from Amazon if Homde is the seller of record.

Homde may use Amazon Attribution or similar measurement tools to understand how visitors interact with links from the Services and whether those links contribute to activity on Amazon. Amazon Attribution is an advertising measurement service used by eligible sellers, vendors, and brand owners; links containing Amazon Attribution tags are not affiliate commission links. Information associated with these measurement tools will be handled as described in our Privacy Policy, Amazon’s applicable privacy notice, and applicable law.

SECTION 11 – FEEDBACK

If you submit, upload, post, email, or otherwise transmit to Homde any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise exploit that Feedback in any medium for any lawful purpose, including commercial use, without compensation to you, subject to applicable law and our Privacy Policy.

You represent and warrant that: (i) you own or have all necessary rights to the Feedback; (ii) you have disclosed any compensation, free product, discount, or other material incentive received in connection with it; (iii) the Feedback is truthful and reflects any experience it purports to describe; and (iv) the Feedback complies with these Terms. We have no obligation to keep Feedback confidential, pay compensation for it, publish it, retain it, or respond to it.

We may, but have no obligation to, monitor, edit, decline, or remove Feedback that we determine in our sole discretion is unlawful, misleading, offensive, threatening, libelous, defamatory, obscene, otherwise objectionable, or in violation of another party’s rights or these Terms.

Your Feedback must not violate any third party’s copyright, trademark, privacy, publicity, or other personal or proprietary right; contain unlawful, abusive, or obscene material; contain malware; or misrepresent its source. You are solely responsible for Feedback you submit and its accuracy. To the fullest extent permitted by law, we assume no liability for Feedback submitted by you or any third party.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

The Services may contain typographical errors, inaccuracies, omissions, or outdated information relating to product descriptions, images, dimensions, specifications, compatibility, prices, promotions, availability, seller identity, shipping charges, or delivery estimates. We reserve the right, without prior notice, to correct, remove, clarify, or update information on the Services at any time.

Updates to Amazon or another third-party website may not appear on the Services immediately. Homde has no authority, solely through operation of this website, to correct or cancel an order placed on Amazon. If a discrepancy affects an order, the information on the applicable Amazon product page, checkout page, and order confirmation governs, subject to applicable law and the marketplace’s and seller’s policies.

We undertake no obligation to amend, update, or clarify information except as required by applicable law. No stated update date should be taken to indicate that all information on the Services has been modified or refreshed.

SECTION 13 – PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not access or use the Services, directly or indirectly: (a) for an unlawful, fraudulent, or malicious purpose; (b) to violate any international, federal, state, provincial, territorial, or local law, rule, regulation, or ordinance; (c) to infringe our intellectual-property rights or the rights of others; (d) to harass, abuse, threaten, insult, harm, defame, slander, disparage, or intimidate any person; (e) to transmit false, deceptive, or misleading information; (f) to upload, download, send, receive, use, or reuse material that does not comply with these Terms; (g) to send unsolicited advertising or promotional material, including junk mail, chain letters, spam, or similar solicitations; (h) to impersonate or attempt to impersonate another person or entity; or (i) to engage in conduct that restricts or inhibits another person’s use or enjoyment of the Services or that, in our judgment, may harm Homde, Shopify, Amazon, their users, or any other person or expose them to liability.

You also agree not to: (a) upload or transmit viruses, malicious code, or harmful material; (b) reproduce, duplicate, copy, extract, sell, resell, or commercially exploit any portion of the Services; (c) collect or track personal information of others without authorization; (d) spam, phish, pharm, pretext, or scrape the Services; (e) use robots, spiders, data-gathering tools, automated devices or processes, agentic AI, or other automated or manual means to access or extract from the Services except as expressly authorized by us in writing or permitted by applicable law notwithstanding this restriction; or (f) interfere with, bypass, or circumvent security, authorization, rate-limit, robot-exclusion, or access-control measures.

We may suspend, restrict, disable, or terminate your access to the Services without notice if we reasonably determine that you have violated these Terms, created risk or potential legal exposure, or interfered with the Services or other users.

SECTION 14 – AGENTS

14.1 This section (“Agent Terms”) applies if you use, allow, enable, or cause an Agent to access, use, or interact with the Services. “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity without direct supervision for each action.

14.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates at all times in accordance with Section 14.4. An Agent must not access, use, or interact with the Services after we have requested that it stop.

14.3 We may use legal and technical measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4 An Agent must: (i) identify itself in HTTP/HTTPS requests and disclose the Agent’s name in its user-agent string using the format “Agent/[agent name]”; (ii) not conceal or obfuscate its automated nature, including by mimicking human behavior or bypassing CAPTCHAs or measures intended to distinguish computer activity from human activity; (iii) respond truthfully to prompts seeking to determine whether an interaction is automated; (iv) comply with published technical instructions and reasonable rate limits; and (v) not circumvent a measure intended to block, limit, modify, or control Agent access to the Services.

SECTION 15 – TERMINATION

We may terminate these Terms or suspend, restrict, or terminate your access to all or part of the Services in our discretion at any time, with or without notice, subject to applicable law. Termination of access to the Services does not cancel or modify a transaction separately completed on Amazon or another third-party website.

The provisions concerning Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive will continue after termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information presented on or through the Services is made available for general informational and product-discovery purposes. We do not warrant its accuracy, completeness, timeliness, reliability, or usefulness. Any reliance you place on it is at your own risk. To the fullest extent permitted by law, we disclaim responsibility arising from reliance on such materials by you, another visitor, or anyone informed of their contents. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. HOMDE DOES NOT, SOLELY BY DISPLAYING OR LINKING TO A PRODUCT, MAKE A WARRANTY REGARDING THAT PRODUCT OR THE THIRD-PARTY TRANSACTION. ANY PRODUCT WARRANTY IS THE WARRANTY, IF ANY, EXPRESSLY PROVIDED BY THE MANUFACTURER OR SELLER OF RECORD IN CONNECTION WITH THE AMAZON TRANSACTION.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMDE, ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS, AND SHOPIFY AND ITS AFFILIATES (COLLECTIVELY, THE “HOMDE PARTIES”), WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, SAVINGS, BUSINESS, GOODWILL, OR DATA; REPLACEMENT COSTS; OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, ARISING FROM OR RELATING TO: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES; (B) ERRORS, OMISSIONS, DELAYS, OR OUTDATED PRODUCT INFORMATION; (C) THIRD-PARTY LINKS, WEBSITES, MARKETPLACES, SELLERS, PAYMENT SERVICES, CARRIERS, OR CONTENT; OR (D) PRODUCTS OR SERVICES VIEWED THROUGH THE SERVICES OR PURCHASED ON A THIRD-PARTY WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE HOMDE PARTIES FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO HOMDE FOR USE OF THE SERVICES DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION APPLY TO THE OPERATION OF THE SERVICES. IF HOMDE IS IDENTIFIED AS THE SELLER OF RECORD FOR A PARTICULAR AMAZON ORDER, LIABILITY ARISING FROM HOMDE’S ROLE AS SELLER IS ALSO SUBJECT TO THE TERMS APPLICABLE TO THAT AMAZON TRANSACTION AND ANY NON-WAIVABLE RIGHTS UNDER APPLICABLE LAW.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY. IN THOSE JURISDICTIONS, LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, WHICH MAY INCLUDE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, DEPENDING ON APPLICABLE LAW.

SECTION 18 – INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Homde, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, judgments, awards, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to: (1) your material breach of these Terms or a document incorporated by reference; (2) your violation of applicable law or a third party’s rights; (3) your Feedback or other content; or (4) your misuse of the Services. This obligation does not apply to the extent a claim was caused by the indemnified party’s own fraud, willful misconduct, or other conduct for which indemnification cannot lawfully be required.

We will give you reasonably prompt notice of an indemnifiable claim, provided that delay will not relieve your obligations except to the extent you are materially prejudiced. We may control the defense and settlement of the claim at your expense, including selection of counsel, but will not settle a claim in a manner that imposes an admission of wrongdoing or non-monetary obligation on you without your consent, not to be unreasonably withheld. You will reasonably cooperate in the defense, including by providing relevant information and documents.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be deemed severed without affecting the validity and enforceability of the remaining provisions.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and any policies or operating rules posted by us on the Services constitute the entire agreement between you and us concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals, whether oral or written, concerning that subject. Terms governing an Amazon purchase form a separate agreement between you and the applicable marketplace and seller of record.

To the extent permitted by applicable law, ambiguities in these Terms will not be construed against a party solely because that party drafted them.

SECTION 21 – ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent, and any unauthorized attempt is void. We may transfer, assign, or delegate these Terms and our rights and obligations in connection with a merger, acquisition, corporate reorganization, sale of assets, change of control, or by operation of law, and otherwise as permitted by applicable law.

SECTION 22 – GOVERNING LAW AND VENUE
